True enough, registering your marriage in Thailand is not only a romantic prospect but very convenient and cost effective for foreign couples and foreign-Thai couples alike.
However, the most telling reason why foreigners flock to Thailand to get married apart from the reasons above is the legality of Thai marriage worldwide. Once your marriage in Thailand has been duly registered, as stipulated in Thai laws, it will be lawfully and internationally recognized.
One important clarification to be aware of at this point is that according to Thai laws, Betrothal Ceremony, Matrimonial/Wedding Ceremony and Marriage Registration are independent of each other which means that you can skip all the ceremonies and go straight to the Marriage Registration if you only prefer your marriage to be made legal or if you are only after the marriage license or certificate. Indeed, the wedding ceremony is not a prerequisite for the Thai marriage registration.
Marriage Registration under Thai laws is very simple and straight forward as long as all required documents have been properly prepared. You are not required to dress up or follow any formalities. All you need to do is to gather all required documents and to be present together with your loved one at any District Office in Thailand, called ‘Ampur’ in Thai language, to complete a few forms and sign both of your names in front of a registrar. After completing the registration formality, you will receive two copies of original Marriage Certificate and right there and then you have both legally become husband and wife.
Anyway, before proceeding to ‘the Ampur’ to register your marriage the following documents must be prepared beforehand
Copy of Identity Document
• For Thais: ID card and Household Certificate
• For Foreigners: Passport together with arrival card
Certificate of freedom to marry from the Embassy:
This document is required ONLY when the marrying person is a FOREIGNER, basically, to verify that the person is single or not currently married to anyone else. According to Thai laws, the Certificate of Freedom to Marry (name varies depending on the Embassy) must be issued by the foreigner’s respective Embassy in Thailand. Note that that every embassy has sets of requirements prior to issuing this document so it’s prudent contacting your embassy beforehand to enquire on the requirements which you need to bring. Also the processing time and processing fee varies per embassy. Some issue the affirmation on the same day while others take a day or two to process the document. Once the document has been issued from the Embassy, it needs to be translated into Thai; then, the Thai translation together with the certificate must be legalized by the Consular Section of Thailand’s Ministry of Foreign Affairs.
Divorce Certificate or Death Certificate, if any:
If any of the marrying party had been previously married, a Divorce Certificate must be shown if the marriage had been terminated by divorce; or, a Death Certificate if the marriage had been terminated by the death of the former spouse. For the foreigner, this certificate is especially required when applying for the Certificate of Freedom to Marry at your embassy and during the actual marriage registration.
Medical Certificate:
A marrying woman is required to present a Medical Certificate at the time of the Marriage Registration if she has just divorced or become a widow for less than 310 days. The Medical Certificate must be issued by a qualified doctor to verify that she is not pregnant.
